Alabama Attorney General Steve Marshall has obtained a temporary restraining order against Legend Windows, LLC for defrauding customers into making deposits for windows and doors that were never delivered. The order, issued by Shelby County Circuit Court, includes individuals associated with the business, including Jody Ray Whitworth, Bobby Ray Whitworth and Robin Simmons Willard. The order includes an asset freeze and prohibits the business from operating while the legal system reviews the case.
Marshall emphasized the importance of holding Legend Windows and the Whitworths accountable for their fraudulent activities, stating that they have exploited their user base for far too long. The defendants have a history of stealing property and have continuously engaged in deception without remorse.
The state’s lawsuit alleges Legend Windows violated the Alabama Deceptive Trade Practices Act on 42 occasions, affecting over 40 victims across the state who are collectively owed $181,042.80 in damages. Jody Whitworth is accused of misusing customer payments for personal purchases instead of delivering promised products and services.
Between September 2022 and March 2024, the Legend Windows bank account was used for over 1,100 purchases from Amazon, totaling approximately $50,000. In addition, the business made purchases from a variety of retailers, including Tema, Etsy, JCPenney, TJ Makk, Ross
