The Chancay port, set to open in November during the Asia-Pacific Economic Cooperation conference in Peru, is facing an unexpected challenge just months before its inauguration. The port, operated by Cosco Shipping, was granted exclusivity over the services to be offered on site. However, Peru’s port authority has recently reversed its stance and said that exclusivity was a mistake. Now they say the port should be open to other companies offering services such as loading and unloading shipping containers. This sudden change could potentially alter the business plan for the port.

The Chancay port has attracted attention due to trade tensions between the US and China in South America. US officials have criticized Peru for allowing a state-owned Chinese company to lead such a major infrastructure project in the country, noting that US firms have not made similar investments in the region. However, Peruvian authorities are defending their decision, citing a lack of private sector interest from US companies.

Once operational, the Chancay port could revolutionize South American trade by providing a direct route from Changcai to Shanghai. Exclusive deals are common in Peru, allowing port operators to recoup their investment by charging for the use of the infrastructure. However, Chancay’s legal structure differs from other Peruvian ports because it was developed from the beginning as a private entity, unlike public ports that were later ceded to private operators.

Despite this regulatory challenge, Transport and Communications Minister Raul Perez Reyes confirmed that Chancay Port will be inaugurated in November. The government is working on adjusting regulations to address this issue of exclusivity with the aim of creating a fair framework for all parties involved. Cosco has criticized Peru’s position on exclusivity over services as being key to their investment in the port and argued that this challenge is negatively affecting Peru’s investment climate.
