Uber Eats driver Pa Edrissa Manjang has recently received a payout after facing “racially discriminatory” facial recognition checks that prevented him from accessing the app and securing a job. Initially, when he started working for Uber Eats in November 2019, the app did not regularly require him to submit selfies for job registration. However, the Microsoft-powered Uber Eats app increased verification checks, which led to his account being removed in 2021 due to “persistent non-compliance.”

An Uber representative explained that real-time ID verification aims to ensure safety for all users of the app, with human oversight to prevent unfair decisions that affect someone’s livelihood. The Equality and Human Rights Commission (EHRC) and the Union of Application Drivers and Couriers supported Mr. Manjanga’s case, expressing concern that facial recognition AI has unfairly affected his income. The ADCU pointed out that the number of selfie requests amounted to racial harassment.

Mr. Manjang was eventually reinstated and still works for Uber Eats in Oxfordshire, stressing the importance of his case shedding light on the challenges of artificial intelligence, particularly for workers in the low-wage economy. He hopes that the decision will further strengthen the rights and protection of workers, especially those from ethnic minorities. Baroness Falkner, chair of the EHRC, criticized the opaque processes Mr Manjang had to navigate and stressed the need for clearer routes to challenge such technology.

Previous cases involving ethnic bias in technology have raised concerns about its impact on individuals. Mr Manjang’s case draws attention to the need for transparency, oversight, and safeguards in using artificial intelligence in workplaces to protect workers’ rights, especially those from ethnic minorities.
